The DWI Process

    Contact Counseling and Diversion Center PLLC to schedule your DWI assessment. We strongly recommend completing this early in your legal process—ideally before your first court appearance—since many attorneys advise having it done at that stage.
  2. Bring the Required Documents
    At your appointment, please bring the following:
    • The $100 state‑mandated assessment fee
    • Your North Carolina Motor Vehicle Record, plus any out‑of‑state records (if applicable—please let us know when scheduling so we can outline any associated fees)
    • Your citation and breathalyzer printout
    • If convicted: a certified copy of your court judgment (the breathalyzer printout may be omitted if BAC is included in the judgment)
    • If not yet in court: your attorney’s contact details, so we can liaise on your behalf
    • Any prior treatment documentation, including facility names, dates, and locations
  3. Duration of Assessment
    The evaluation typically lasts between 60 and 90 minutes.
  4. Assessment Results & Treatment Letter
    Once we receive all required documentation and complete your evaluation, we will prepare a treatment recommendation. Submitting all items promptly helps expedite this process.
    You’ll receive a letter confirming your completed assessment, which you can present to your attorney, probation officer, or court as proof.
  5. Recommended Treatment Levels
    Depending on the results of your assessment, one of the following treatment plans may be recommended:
    • ADETS — Alcohol & Drug Education Class (16 hours)
    • Short-Term Treatment: minimum 20 hours, completed within at least 30 days
    • Longer-Term Treatment: minimum 40 hours, completed within at least 60 days
    • Intensive Outpatient Treatment: minimum 90 hours, completed within at least 90 days

    The final service level will be determined during your intake.

  6. Post‑Assessment Steps
    After reviewing your results, we will contact you to discuss the findings and provide guidance on the next steps. You will also receive a letter outlining the requirements necessary to reinstate your driving privilege.

    Please call our office promptly to enroll in the appropriate treatment program. During this call, we’ll review available schedules, fees, and walk you through what to expect moving forward.
  7. State Notification & License Reinstatement
    Once you’ve completed the recommended treatment, we will notify the state on your behalf—typically within two weeks of completion.

    After state approval is confirmed, it is your responsibility to contact the DMV directly. They will provide information on licensing fees, hearing requirements, and any additional steps necessary to reinstate your driving privileges.
